I.S.A.条文知多少 ？

I.S.A. = 内部安全法令－Internal Security Act 1960

目前， 最热门， 也是大家 极关注的两个条文是第73条文和第8条文：

Section 73 - Power to detain suspected persons

(1) Any police officer may without warrant arrest and detain.. any person..whom he has reason to believe -

(a) ...

(b) that he has acted or is about to act or is likely to act in any manner prejudicial to the security of Malaysia...

(2) ...

(3) Any person arrested under this section may be detained for a period not exceeding sixty days without an order of detention having been made in respect of him under section 8.

根据上速条文，一名警官，有权扣留任何人，长达六十天，假如他（警官）有理由相信，该名人士的行动会危害到国家安全。

Section 8 - Power to order detention or restriction of persons

(1) If the Minister is satisfied that the detention of any person is necessary with a view to preventing him from acting in a manner prejudicial to the security of Malaysia or to the maintenance of essential services or to the economic life thereof, he may make an order (detention order) directing that that person be detained for a period not exceeding two years.

根据第八条文（1）项，基于国家安全理由，内政部长有权扣留任何人，长达两年时间。

我们还记得，ISA 的制定，主要是用来对付后紧急状态时期（1948－60年）的地下共产活动（“颠覆”份子），因为，当时政府认为“地下”份子的活动，对“国家安全”构成威胁。

可是，今天“颠覆份子威胁国家安全”的问题已不复存在； 今天国内的异议份子，都是一批服膺议 会民主 政 治的大马公民； 把他们当着“颠覆份子”看待， 援 引ISA来对付他们，未免有欠公平· 不合理· 且极不民主。

更何况，ISA的不合理条文，严重的抵触了联邦宪 法所赋予的三权分立原则； 因为，此法令所赋予政府(Executive)的控告及判决权，完全绕过（bypass)了司法(Judiciary)的功能与权力。

你说，ISA的继续存在，是不是大马民主的一大讽刺？
